I have had a partial refund from my bank as a 'goodwill gesture'. they have stated that the OFT ruling refers to credit cards and they don't believe it applies to current accounts.

did you get the standard letter offering the cash back in Full and final settlement, if so then don't sign the letter as it is, delete the line stating "as a full & final settlement" and insert "as an interim payment" and post it back to bank with the lba template (with your relevant details) with the line, "Firstly, with regards to your recent letter following my correspondence, I would like to accept your goodwill gesture to repay £XXXX of the money taken from my account over the past X years. This is in no way a settlement but will be regarded as an interim payment." inserted as the first paragraph. Start the next para "Secondly, I understand that the regime etc....". That is of course if you haven't already sent your LBA in. If you already have then accept the interim settlement as above and inform them that you are going to proceed to court for the rest!
