I had a non fault accident.
The other insurers decided my car was worth £350 and gave me 48 hours to provide proof of my car being worth more. IS THAT FAIR/LEGAL?
They then sent a cheque for the £350 that I hadn't actually accepted.
The courtesy car people then advised me if I did not return the car they would charge me £36 per day.
THEN...they came and took the car with no notification. No paperwork through the door and my belongings were still in the car.
I reported car as stolen as was weekend and could not contact car hire company to check if they had it.
They have so far not returned my belongings and deny knowledge of a previous conversation where they said they would drop back to me.
They are in Luton I am in London.
Where do I stand on this legally - surely this is theft of my belongings?

Once a vehicle is declared a total loss it becomes the property of the insurance company, so I don't think it would count as theft (though others on this forum are more au fait with this).
Normally they would send a cheque out (whether you agree with it or not) and then if you disagree they would send a further cheque if they agree with your valuation. But putting a time limit on it is unfair in my opinion. I would ask them to hold the vehicle whilst you dispute acceptance. someone else will come along with more (helpful) information.

Sorry, I didn't make this clear. It was my belongings in the hire car they took!
However they deemed to return them this morning at 6.30AM!!! They wan't the car key back but not all goods returned so holding onto them until I get all back. They have a spare key coz they took the car!
