Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
Ok booked a holiday a few weeks back for me and three of my friends....... It was booked in my name, as lead passenger, and a "Low Deposit" of £25 pp was taken out of my account
I yesterday found out that 2 of my friends wish to cancel as they now cannot afford to go......
I read on my booking confimration that if this is the case the full deposit needs to be paid, this is £130, which minus the £25 already paid, means that to cancel each of us need to pay £105
I told this to my two friends who want to cancel and they said that they cannot afford to pay this, and have basically refused
My question is, am i liable, as lead passenger, for the rest of the deposit for my "so-called" friends
and also is there anyway i can cancel and not have to pay the other 105 to First Choice
Unfortunately the contract is between yourself and the agent/travel company. Therefore it is you who is liable for any monies owed and you will then have to reclaim it from your friends.
Chesterexpress is correct, also I think you need to carefully check the holiday details, for example if it was based x people sharing you may have additional charges.
So if i want to cancel First Choice want the rest of the deposit which is 105 per person
so if i ring them and pay my 105 they'll expect me to pay for the other in my party who basically have no money and are refusing to pay
dont i have no rights here, surely something has to work in my favor
Hi
Sorry I think you are correct you will have to pay the balance of the deposit £420.00 before you can then cancel.
Could you and your remaining friend go its seems a shame to loose a total £520.00, that is assuming you did not get the original money(£25.00) from them
dont i have no rights here, surely something has to work in my favor
You entered into a contract, therefore you are responsible for the deposit and if you were to go ahead with the holiday, you as the lead passenger would also be responsible for the full balance outstanding. It is for you to get the money off the other three. Why on earth did you all agree to go on holiday and within a few weeks decide you can't afford it?
