Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
I took out a car loan in Jan 98 with Woodchester Finance, which ran for 5 years - so up until Jan 2003.
Whilst sorting out all our paperwork generally I came across the original HP Agreement for this and noticed that (in their terminology) Credit Protection Insurance was added to this. I presume this is the same thing as PPI?? I've not had any exposure up until now with the whole PPI area as I never normally opt for it!
Now I would never normally opt for this and at the time I was self employed - as was my husband so this would not have covered us anyway.
No you can probably still make a claim. I say probably because I am just starting out on my own claim and therefore not fully up to speed on all the legalities yet. the Financial Ombudsman Service (fos) option is out because they only deal with consumers who started a PPI loan after the FSA ruling i.e. 14 January 2005 so any loans with PPI before this will have to be dealt with through the Courts service.
Firstly can I ask what more information do you have on woodchester finance? any addresses etc.
You have the HP agreement is this a HP agreement or a Consumer Credit Agreement?
Even though you fall outside of the FSA ruling and the option of complaining to the FOS I believe the Woodchester finance would have to fall under the rule of some authority.
If you can supply some more information on the Company I will try and find out where you can go next in your quest for refund.
"Hire Purchase Agreement regulated by the Consumer Credit Act 1974"
I have an address for Woodchester as printed on this agreement (which dates from Jan '98 so is likely no longer valid):
Woodchester Finance Limited
Woodchester House
Selsdon Way
Docklands
London
E14 9HA
Yes I would suggest the HP agreement is then in the same category ( and I am no authority on this ) as the Consumer Credit Agreements within the Consumer credit Act 1974.
Hope the links are helpful I believe the GE may have changed address but you can always do a google search to find them!!
the bank templates thread has been temporarily moved to update the letters. No sure if you would find anything in there as I believe it was many aimed at recovering Illegal Bank Charges.
The best advice I can offer is to search some of the Threads and see what other people have been sending off to reclaim the PPI there are many around just takes a bit of time to find one to suit your circumstances.
I would not like to give you just one example and find it did not work for you.
