Hi everyone. I,m new to this forum so please bear with me if I have posted on the wrong thread.
I have a problem with HFC bank who have registered an arrangement to pay on my credit file regarding my Marbles Credit Card. I have never entered into an arrangement to pay with them and have always paid at least the minimum amount due on my statement. This 'arrangement to pay' was entered in 2006 when I was up against it cashwise. I didn't miss any payments but I did pay quite a few late (Never any default notices or letters). There are two issues which are the only things that I can think of that would lead to them doing this, although I think it would be unfair to declare either as an 'arrangement to pay'
1. I usually paid using their internet facility but they blocked my access on one occasion so I rang them to make a telephone payment and to request them to unblock my access to my account to which they replied that they would only do this if after I made three consequtive payments on time.
2. I rang on a Sunday evening to make a payment and was told that they could not take payments at that time and I would need to ring back.
All HFC are saying is that, according to their records 'I agreed to make a payment' and this constitutes an arrangement to pay and are referring to these telephone conversations.
Incidentally, I owed around £6k to them at the time bit I am now £1 in credit and am pursuing them for my charges back.

Is it correct to assume that you are questioning negative entries on your credit files ?
There appears more than one issue here.Have you done a S.A.R. to the bank yet ? If not you should so so.In your request specify that you want a copy not only of the transactions and charges history,but also all records of communications between you and them.Tell them that you do not consider telephone conversations as an acceptable form of agreement and they should produce your written instructions.
You are entitled to add a notice of correction to your credit files which stays there pending the CRA contacting the creditor to clarify things.
Although your issues are alleged debt related you do not say if there were/are DCAs involved or the banks in house collections.and as you are going for refund of charges I think it should be moved to HSBC forums.

You have had some great advice there, you need to find out exactly what the bank has in the way of records so the first step is an SAR including a request for both copies of your statements (so you can calculate the charges accurately) and the correspondence / record of telephone calls so you can see exactly what they have based their notices to the credit reference agencies on.
Thanks for your response. You are correct - I have sent for, and recieved a copy of my credit file and my record shows 'AP' for one month (August 2006). for Marbles. Other than that the entire three year record for this account shows all zeros. I had recieved a reminded letter from their in house collections dept but have never received a Default letter, and it has not been referred to a DCA. I have never made reduced payments and have cleared the debt. I have also never missed a payment - I have made payments after the due date but not actually missed a payment.
I have attached a notice of dispute on my file, and sent for and received a SAR from HFC - but they only sent a record of the past six years transactions (but to be fair thats all I asked for). I'll take your advice and send for another one using your suggestions.
