Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.

Sorry to hear of your troubles. Please just know that you are not alone in this.
I know that what I am about to say will not make you feel better instantly, but think about it a while.
Nobody ever died of being in debt.
(a bit like you can't be killed by a gun, but only by the person firing the gun).
First thing that you need to do is get down to the citizens advice bureau. They will offer you some support in arranging reduced payments with your creditors - please don't agree to anything straight away though. There are other things to do afterward.
Be very firm with yourself and family and work out a realistic budget (there is a budget planner spreadsheet in the templates library). Try to include all of your outgoings and allow for contingencies. That's the first step.
Once you know all the things that you NEED, you should have a figure that you can allocate to your creditors. Ask them to take into consideration your willingness to pay and your will to avoid default positions, even if it will take you a while longer to pay them off.
Mostly they will accomodate the arrangement, as it actually costs business a lot to recover defaulted debts.
There are many options to get you out of the circumstances you find yourself in.
Then, we will start on the bank, when you feel a bit stronger - I advise this as you need to make some choices, and you need to have a balanced mindset to make the right choice for you and yours.

If you are already a month in arrears with a secured debt it may be a blessing in disguise that you have been turned down for another Sounds like you already have the wheels in motion for reclaiming your bank charges. Where are you at? Are you struggling to pay the credit card bills at the expense of other priority expenses? A CCA letter (Consumer Credit Agreement) is a request to provide a copy of the orginal agreement between yourself & the original creditor. Are there any unlawful charges on the credit cards that you can reclaim? Please make sure that your priority debts are paid first ie. mortgage, council tax, utilities (gas, electric, water, tv licence fines etc). Credit cards are low priority compared to other debts Need any more info please ask

Can you explain why you think you are a hardship case? The fos may consider your case out of the court system but you may have to prove that the charges caused your hardship ( of which there is no set definition) or at a minimum seriously worsened your position?

To argue hardship you will need to show you qualify.Generally speaking this means that you are struggling to pay for essential day to day living expenses after priority debts. There is a nore detailed explanation on the OFT website in the waiver criteria. In the first instance after you have notified them they are required to send you a means enquiry form to fill out and return.
You may be eligible for help with your claim from the Court...you may be entitled to some remission of fees based on your disposable income.
Courts also have discretion to allow claims to be filed and paid for later if the financial circumstances warrant it.You should speak to the Court manager about that.

ok my advice to you is to do an income and expenditure sheet be honest about it and see where you can cut back. Ring your creditors and tell them the payments you can afford to make and do not be talked into paying anymore.Alternitively you could ring the cccs and they will do all this for you if the circustances allow.good luck!
No-agreeing or arranging ANYTHING on the telephone is a no-no.
Keep everything in writing and keep copies sending by recorded and keeping proof of posting/delivery.

Heres a good trick to remember....when they call you...say "Could you just hold on a minute while I connect my recording equipment up "....see how long they stay on the line !
