    Default Alcossy v RBS

    Hi there all of you absolute stars that help people with these claims...

    I need a bit of help...

    I have sent in my claim twice but my bank says they havent received it so am going for a third time lucky, only thing is my overdrafticon is over the limit (due to unfair charges) and I havent paid it for a while as I wanted to claim these charges back.

    They are now asking me to fill in a finanical hardship form...

    I intend to send it back with a letter with a schedule of charges on to remind them of my claim and as a student who cannot pay his bills, rent and has no income I think I should qualify for hardship.

    Do I just send the first letter with a schedule of charges and tell them Im not going to pay them anything and the refund can cover my overdraft etc..?

    Cheers really appreciate any advice...

    Hi Alcossy.
    Spend a few days reading the FAQs and the step by step guides. That will give you a wealth of information.
    If you follow our well-tried and tested route you will be ok.
    Don't wander off the path or their legal department will have you for breakfast.
    It is most important that you go about it the right way.
    This is self-help forum.
    We've provided the material, now you do the reading.
    Start your own thread in your bank's forum and ask any questions you have, there. Also, try to keep your thread up to date with progress reports, then anyone offering advice will know what stage you're at.

    Spend sometime familiarising yourself with the site. Make sure you read the site rules and the FAQ's.

    Bank penalty charges verdict -

    i noted that we might have to wait for another year before we might be able to claim overdrafticon charges from banks as the appeal procees might take as long as a year... not sure if i can wait that long or end up with more charges... perhaps a good side of this is to be able to claim an interest rate for another year on the charges occured if that cos possible.. lol...

    Alcossy,Yes fill out the means enq form with your financial details.
    Make sure that you return it recorded delivery and keep the proof of posting.
    By nature of them asking you to fill out the form,they are taking seriously your request.Under the waivericon as agreed with the OFT they must take into account hardship cases.Yes send a schedule of charges as well.
    Tell them if they do not settle the matter to your satisfaction you will be filing in court.The fosicon cannot deal with your refunds if you start court proceedings but you can still report them for failing to treat your case as hardship...if they threaten to close your account then you can report that too.

    Thankyou for the help Martin3030 I have just received a letter stating that my financial hardship claim has been accepted and all interesticon and recovery action has been suspended as the claim will repay the outstanding balance on my account pending the outcome of the OFT court case...

    What do I do now, do I start court proceedings or ask for a cheque?

    Cheers for your help, if this is in the wrong part of the forum please can somebody move it for me? Its an RBSicon account.
