    Default Help! PCN for parking in a loading bay

    Hi, I wonder if you could help?

    My husband received a pcnicon for £70.00 on Saturday @ 17:46 for parking in a 'loading bay'.

    The actual main road is a red route but has a small one way road running parallel to it where drivers can park in front of the shops. He parked up in a very narrow bay in front of the video shop he was going to and actually parked behind the parking attendant who was sitting on his moped. There were also available spaces to his right but he genuinely thought it was a legitimate place to park. At this point he did not notice any visible signs.

    He was in the shop for 7 minutes and when he come out had a parking ticket. The parking attendant then pointed to a sign (which he had been parked in front of when my husband parked his car!) which was about 4 foot high with a blue sign saying 'Loading Bay'. There was nothing else on the sign. My husband then noticed very faint writing on the ground saying 'Loading Bay' but unless it was pointed out to you then you definately wouldn't be able to see it.

    Do you think we have a case to appeal against this? Any help would be greatly appreciated.

    Please someone?

    Just been studying the pcnicon and it states that the contravention is 'Parked in a loading place during restriced hours and without loading'. I have been back to take a photograph of the sign and it only states 'Loading Only' but gives no times?

    Any advice greatly appreciated

    If it gives no times then its either in a CPZ and those times apply or 24 hours a day.

    The bay has broken white lines. The pcnicon was issued by local council. I have got photographs but don't know how to upload them onto here?

    Do you have a photograph of the sign / road markings + have you measured the width of the bay?

    Yes I have photographs. Please could you advise how I load them onto here? I have not measured the width of the bay but when I went to take pics yesterday there were 3 cars parked in the loading bay but all had to park slightly on the pavement as the bay is narrower than a typical size car.

    The bay needs to be a minmum of 1800mm wide.

    For photos, open a photobucket account (Image hosting, free photo sharing & video sharing at Photobucket) and upload, copy and paste the ref that looks like this:

    (but starting and ending with square brackets not curly ones - ie [] not {} )
    It's very easy!

    Works well. When you go and measure the width of the bay, can you take some pictures of the transverse lines (the ones that come out from the side of the road), they could be crucial.

    The "Loading Only" sign does not look right. Check it against this:

    Also, get the dimensions and locations of any "Loading Only" painted on the road.
    Since my last post I've re-thought.
    These seem to be the two options for a Loading Bay:

    And it's not one of these because we can see continuous broken white line.
    So is it one of these:

    Which has to be a min of 2700mm wide
    What I suspect they have done is to use one of these:
    http://www.dft.gov.uk/pgr/roads/tss/...kingbay2sheets
    Which can be 1800mm wide but for which LOADING ONLY is not a prescribed variant.

    Looking at the photos the bollards and sign is beyond the brick paved area so the bay may continue on to the red tarmac area making it easily wide enough if footway parking is permited.

    Fair point but shouldn't there be lines on the footway to show how far on the footway parking is permitted?

    OP, look for and take pictures (showing orientation to traffic flow) of any footway parking signs.
