Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
Back in December I found out that I had a current account still open (from when I was a student) and was two hundred pounds overdrawn. Further enquires revealed that the account was 30 pence overdrawn for a period of time without incurring any penalties. Then for some reason the bank started charging me overdraft fees over the course of year and half.
The address they had for me was incorrect and I never received any letters about the fees being charged, any changes to my current account conditions or any statements. I spoke to the bank via the branch and on the telephone and had the charges removed, I corrected the incorrect address from 2004 that they had for me and then gave them my new address. I then asked for the account to be closed.
Recently checking my credit file I have found out that they have put under linked address 20 addresses I have never lived at or had any financial links with. As well as 11 missed payment alerts with the letter six. This has only now appeared on my Experian file since I gave them the correct address from 2004.
I wrote recorded delivery to them explaining that I have never lived at the addresses specified and asked that the missed payments be removed. I received a phone call today saying that they were not going to remove the negative comments and they had not put the incorrect addresses on my credit file. I also found out that they still had the wrong current address and was using one of the addresses that I had said was incorrect that they had placed on my credit file.
I tried insisting that they write to me with their response but they refused.
Surely if they had the wrong address and it was their mistake then they can’t put negative comments for being 30 pence overdrawn?.
If I was to apply for a mortgage (when everything has settled down with the credit crisis) would having 11 red sixes affect me?
Is it worth just leaving it alone, they currently have the wrong address and when I apply for mortgage or credit card it would be more than 6 years since I have lived at an address that they have correct for me?
Natwest were writing to my son at an address he has never lived at.
Send a formal complaint to the bank, ask for a copy of their complaints procedure. Ask them what information they do share with Experian. I would be most surprised if they don't give your address. If they write to you at the wrong address they probably supplied that to Experian as well.
I'm currently waiting for the reply to a complaint that NatWest say they have replied to. I'm fairly sure that they have sent that (twice) to the wrong address.
