right, In Febuary 08 we hired a car from a company that specialises in car lease for driving instructors. We have paid every payment on time and as it was a 6 month contract there a 3 outstanding payments.
This car has now broken down and looks like it will be out of action for the best part of a month, they provided us with a different car which both the pupils and my partner hate and its not in good condition, its also petrol which his other car wasnt and is costing so much more money to run (my partner had to pick this car up himself resulting in a 200 mile round trip). The company know that we are not happy and said that they were gonna come and repossess someone elses car that lives in the same town as us and that if my partner wanted he could have that car, so he agreed. They then asked my partner to go round to the address and just repossess the car- they were gonna post us the keys! we decided this wouldnt be a very good thing to do so declined but did end up going round to the house to ask for the car, well knowone lives there anymore the house is empty since the poor chap got flooded and knowone knows where he has gone, so that car is now out of our reach at least til the police find it!
the long and short of it is can we get out of the contract
the only thing in the terms and conditions reads something like "under OFT ruling because the value of goods is greater than 1500 the contract cannot be terminated as the vehical was aquired especially for your needs"
However the vehical was not aquired specifically for us it is a second hand car a 55 plate 60000 miles on the clock.
