Just succesfully claimed back all my charges with MINT and they even paid the interest on top. Pretty quickly only took 2 weeks and 2 letters. They replied to my S.A.R - (Subject access request) with an offer straight away and I hadnt even requested the charges back at this point. They did the usual and offered me the difference between the £20 and £12 ones which I declined and a week later have settled in full.
Now, problem is they have refunded back onto my card which is effectively a closed account - I have 5k outstanding on the card and the card is no longer in use due to them withdrawing my credit facilites as a result of non payment and this account is now in dispute in relation to the cca etc.
Can i request this be paid to me in a cheque rather than applied to the account? If so anyone done this and have a handy letter they can post up for me please.

I'm not too sure, I think it could argued as fair and its also reduced the balance, if they paid the amount for example to a DCA who purchased the debt I would say that was unfair.
