Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
This is my first post to this site, but I have been reading some of the messages about the Alliance and Leicester!
My situation is that I opened an account with them in March 2006, always meaning to transfer over to them, but the overdraft facility that they offered me was so paltry, that I just let the account lie dormant.
I always meant to transfer some funds in, but just never got round to it.
So now, two years later, I get a letter telling me that they have withdrawn my overdraft facility. I thought 'fine, I've never used the account so this means nothing to me'.
Then I get a second letter saying that they have removed the overdraft facility - just that, nothing else, and a third letter.
Then yesterday I received a fourth letter which says 'can I do something about the £98.73 I owe them now that I have no overdraft facility.
I had to find all the paperwork relating to this account and got round to phoning them today about it. The stroppy guy on the other end says that because I had not been funding my account with £500 a month, I was charged £5 a month. I asked why it had taken them 2 years to get round to telling me about it, and he said it was my responsibility to look it up because it is an internet account. I said they sent me no statements - he said internet account.
And that was his answer to all my questioning, becasue it is an internet account, they did not have to tell me anything or send me any statements. And finally, after 15 minutes, he said that becasue I had not been servicing the account, they had decided to remove the overdraft facility (Thanks!) and I am now being charged £5 a day, so I owe them another £50
All this for 2 years of nothing! Are these charges that I can claim back?
ive been looking at my charges and have had 34.00 and 25.00 for unathorised overdraft fee, plus underfunding fees of 5.00 a month, plus exceeding the overdraft by 5.00 a day too
so in all i can claim all the above charges?
what about the interest should i add too and take it straight to the court stage if i dont receive satisfactory reply after the initial letters?
many thanks for your advice, if so all the above fees wipe out my overdraft of 250.00 and just over .
I came back from holiday today to find a letter to the tune of £270 and mounting daily. When I phoned, no dept could help or was open so I have to wait till monday and the charges keep growing......!
