Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
I posted here a few weeks ago about my problems with Arnold Clark. In the end I went through another garage and have now had a new car for 2 weeks, and it was so stress and problem free!
Anyway, 2 days ago I arrived home from work to find a letter from the DVLA, It looked like a registration document so I assumed it was for my new car as the garage had sent away the 'new keeper supplement' for me. When I opened it it was a registration certificate, but it was for the wrong reg number, it was for the car Arnold Clark were meant to sell me but they told me it was 'condemned' and no longer saleable.
I then phoned Arnold Clark to ask why I had received this and they didn't seem to have a clue, they just asked me to take it in, when I said yes they asked quite rudely when it would be!
I took it in last night and spoke to the salesman I previously dealt with, he said he meant to phone me to warn me I would receive this. I was in a hurry and didn't ask but why did I get sent this? My only idea is that they have gone and sold this car I was meant to get after they didn't sell it to me. To say I would be mad if that were the case is an understatement!
Why not ask the DVLA? afterall, it is they who sent it to you.

I couldn't find a contact number for DVLA, I have since given the registration document back to Arnold Clark and have been sent out my new one for the correct car. Hopefully that's it solved.

No, it not "solved".
In whose name was the V5 that you gave to Arnold Clark? If it has your name on it, then you remain liable for tax, SORN, parking fines, etc. until DVLA are told that you are not the registered keeper (and Arnold Clark will be in no hurry to do this)
If it was sent by the DVLA, why did you not return it to them?
Thought I would bring a few of these to the top so we can see how many have had any satisfaction from Arnold Clark.

My goodness Conniff, AC must have upset you big time that we have all these posts.
THIS MUST BE A RECORD. We normally only see Arnold Clark mentioned once or twice on the same page.
It would be very interesting to know what the massive Arnold Clark Automobiles Ltd. response to the OFT will be in light of their new regulations for used car dealers.
In one section they appear to have gone overboard in that the advertising of cars for spares or repair is banned. I think they should have allowed this but with the strict qualification that such vehicles must be transported away whether they are runners or not.
Surely the public would not buy a car advertised as such and expect it to be roadworthy at least without work being done on it.
Maybe the idea was to stop the "sold as seen" stamp from being replaced by a "for spares or repair" stamp?
After all, it is rather difficult at the moment to prevent the receipt being stamped "sold as seen", as that is done after you have paid. I have had it explained as "don't worry, trading standards insist we stamp our receipts that way, it does not affect the personal guarantee you have from me".
I suspect that even the requirement to have them transported away would not help, we would just find that some car dealers start delivering cars to home addresses.... just to be helpful, as the car was not ready at the right time, etc. After all, delivery would not cost anything like as much as complying with the new regs.

This is of concern - 'who' explained that to you ????

It is an offence to limit buyers rights and by adding 'Sold as seen' is limiting buyers rights therefore is an offence under the Fair trading act.
You have been told porkies to keep you quiet.

The owner of the car sales lot, when he sold us the car. It was literally stamped on the receipt as we were going, and he really did tell us it was a requirement from trading standards.
Coincidentally, the car turned out to have been clocked. We got a refund, by cheque, and the cheque bounced. My husband ended up crossing Liverpool with £6000 in cash in his case.
It was this event that triggered my deep and abiding interest in the law that stops people like this getting away with it, as the seller tried every trick in the book to not give us our cash back.

You say the "owner of the car sales lot". You need to confirm if this was an Arnold Clark car site or not??

Thanks for that - It is important that we make that clear.
