Hi I took out a loan last year for 5000 and have to pay back 5000 on it over 10 yrs. Im about to send off for my CCA just to check everything is as it should be, I think I also signed a deed of assignment or this was a legal charge, Im sure ill find out soon enough though. Anyway a witness had to sign this and the witness was the agent who came to our house with all the paper work, so im just wanting to know if this is allowed?. thnx.
The document you signed is likely to be a deed giving the lender a legal charge on your property. A deed of assignment is only used when the debt is assigned eg if it is sold to another lender. I don't believe there is a requirement that the witness needs to be independant the witness is there merely to attest the signature.
