Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
I got a parking violation from a private parking company and not sure if I have to pay. I didnt see the signs cos I was talking to my friend when i drove in. (it never used to be) the only problem is the signs were very obvious. I read on this forum these fines are contracts. Is my fine a contract even though i didnt see the sign. also the ticket says something about liquidated damages but I am not really sure what that means. Any help would be great.
It is a private ticket therefore it is a [problem], you should ignore. You will get threatening "reminders" through the post - they will get the registered keeper details through your number plate from DVLA. If you get a letter claiming to be from a debt collection agency, write back denying any contract, denying any debt and insist the matter be referred back to the Parking Company.
See the "sticky" at the top of the forum "Private Parking Companies" [legal pete's article]. This explains in some detail all about the [problem] and why you should not be concerned.
Its not a [problem] if the signs are clear and terms have been breached its perfectly legal to seek damages. However the scheme has one sticking point and that is that the Parking co. cannot prove who parked the car which is why payment is not worth making.
