When you exchange council properties and are given the deed of assignment i understand that you are taking over the tenancy from the persons you exchange with.Does that mean you take over any restrictions thay have had on their tenancy because they were bad payers and various other issues ....
I have been refused an exchange to another property because the council say i dont have a full tenancy.due to the problems the other tenants were in!!!!!!!!! I have to prove to them i am a better tenant than the previous ones......
I have been a tenant for over 20 yrs and NEVER missed a rent payment........Prove enough dont you think?? So why am i being punished for the way they behaved.......
No mention was made about this when i exchanged and my deed of assignment has nothing pertaining to this on it............I have never had a problem like this before and i have moved several times......I am in shock to be honest it surely cant be right...............
I desperatly need to move as my husband has left and i am devastated,my two sons and two daughters all live in the same town a good 40 mins away from me,i dont drive so im here on my own with no support..........
I found the perfect move a few minutes away from my daughter and was unaware of the problems i now face.Im gutted and i dont know where to go from here.............the best part about it is......The couple who i exchanged with have moved again with no problem at all !!!!

No, you cannot be held liable for the former tenants' behaviour any more than they can gain from your good record. The council are wrong and I would speak with your local councillor about it.
have just got off the phone to my HA who tell me that i have indeed taken over the previous bad tenants history............Rent arrears and asbos
I am on a starter tenancy even though i have been a model tenant for over 20 yrs,that means i am on probartion and cannot move untill i have shown good character over the year..............
She told me that was law and that i had a letter about it before i moved .
I DID NOT or i would not have gone through with the exchange........
They will not budge HELP
I'm not a housing expert, but I would ask her to show you the law which says you are responsible for the previous tenants' actions and ask her to put it in writing. I fail to see how a HA could enforce a probationary tenancy on you when you have done nothing wrong.
As for an ASBO, these are given to individuals, they are not assigned to tenancies.
Do you have a copy of your new tenancy agreement and does it say anywhere on there about it being probationary?
i have a deed of assignment.which states i have an assured tenancy in accordence with the housing act 1988 section 17.
no mention of starter tenancy or anything............ the housing officer wont budge saying this is what they do to everyone taking over a property with previous bad tenants..........
Cant get through to CAB the housing corps wont help unless i want to make a complaint.....I just wanted to know if this is indeed law,or law unto themselves............
Sounds to me like a law unto themselves. This is a quote from my HA:
"Existing tenants transferring to us from the
council or from another housing association,
cannot be signed up to Probationary Tenancies.
We are not allowed to offer Probationary
Tenancies to households already holding a full tenancy"
