Ok received my request yesterday morning with statements all the way back to when I opened the account June 2003
Now my question is this...
What charges can I deem as unlawful with a credit card, as from what i have read to date is slightly different to that of bank current accounts.
And charges in more recent times of £12 - do we claim for these too?
interest - how does it work with a credit card account? This surely is very different?

thanks for that slick, right I'm usng the excel advanced calculation sheet, one query... what do I put as the "interest charged" (coloum G) which is set at 12.5 as default.

Print the updated SOC (it auto-updates when you open and print it again) and send off with lba.
Ok done today with update on charges as had a new one since last letter, sent today with copy of prelim - to which they didnt respond to at all, all sent via recorded 1st class. See if they get the point this time eh.

Have actually received a letter back from Barclaycard this moring interestingly dated the 12th yet it is now the 16th. They trying to cover their back sides perhaps? But anyhow it has thrown me after sending off my LBA on the 15th.

I am sorry you feel the charges you have incurred are unfair. We believe that our charges are both fair and transparent, and we make them very clear in our terms and conditions, and on the reverse of every monthly statement.
In your correspondance you have outlined a legal argument which you say supports your view. As I am sure you will appreciate Barclaycard is aware of all the information you have drawn to our attention. I must inform you however, that we disagree with your legal analysis.
Putting the above to one side, as a good will gesture and without any admission of liability, I am prepared to credit your acount with the difference betwen the charges you have incurred and the current £12 fee. This would amount to £269.00, plus 8% interest.
The adjustment will be confirmed on your next statement.
Now seeing as my request is for £1888 (charges and interest figure combined) this seems way below what I am owed
Advice please, what should I write back to them on this occasion, taking into account I sent them my lba on the 15th, as I didnt receive this letter until today, with an update of charges applied since my prelim letter.

Right I think BC are trying to throw me off their scent now, they have sent this letter (linked below) and have already added the amounts detailed onto my BC Credit Card, which with a £400 limit has left me with a balance of £-513.44... basically £513.44 that I could presumable take now without it being accounted as credit, however is this them baiting me? I assume if i touch even £0.01 that would basically be me accepting in full their "final settlement"

It works out they have credited me £1,184.94... please see my recent transactions on my account for clarification.
So in total they've refunded £1,148.94 which leaves you short by approx £740 of the total chgs + int't of £1,888 you quoted above.
If you still want to go ahead and file your claim including CI, do so now as they've made this their final response.
Use another rejection letter from the link above (bear in mind this is a final offer) telling them you reject their offer and they can take back their money if they wish.
Advise now, this has all occured after me sending my lba and rejecting their original settlement offer.:confused :
Nothing to be confused about as far as I can see.
Be aware that claiming CI will mean they will drag this out right up to a final court hearing date. You will have to prepare and submit your court bundles to the court and to BC.
If they settle before court, you can apply for a Wasted Costs Order which you may or may not get, to compensate you for your time and effort in preparing the case ready for court.
