    Default Verbal agreement on buying a car and readvertising at a higher price? Is it legal?

    My OH recently phoned a car company in Madenhead Kent. The Moto Company. They had an MG advertised in Auto Trader at Just under £1500. My OH agreed to buy it, they insisted on taking his card details as a 'deposit' until he could go up there so that they knew he was a serious buyer, (we are in Cornwall). He gave them details etc and booked a train ticket up to go and collect the car tomorrow. Today they rang and said they'd had a higher offer and have sold it. They now have it advertised on Auto Trader at £2095, so they obviously haven't sold it, they have just decided they want more money for it. Can they do this legally? I'm disgusted and would advice anyone against dealing with them at all.

    Make sure you notify your bank about the fact they have your card details, they might be crooks.

    If you can prove the agreement (i.e. you have witnesses etc) then you can raise a court application for specific performance. Do a google search on the phrease.

    The law of contract states:

    Acceptance is the agreement to all the terms of the offer an unconditional agreement.
    Acceptance can be in writing orally but it also may be by conduct.
    As he has accepted your deposit, (conduct), I believe he has made a contract.

    Contact Trading Standards asap.

    If they have actually taken money out, I would agree with you, but it is impossible to prove if they just got the details and didn't take money out.
