    Default Is the car dealer at fault?

    I bought a car for me and my daughter to share,in September last year, it was sold with 8 months car tax (supposedly).
    Fast forward to yesterday and my daughter was pulled over by the police and informed that our car was untaxed! He then proceeded to look at the tax disc, then started to read her her rights as he was planning to arrest her for fraud - the disc was for another car of the same make, with a similar reg number. She obviously got very upset and explained that I was the owner and registered keeper etc. etc.
    He must have believed her and gave her a fine of £60, he didn't even ask to speak to me when she asked him if she could call me, he didn't require me to even produce my documents at the police station, which I was more than happy to do as it's mot'd and insured properly.
    My hubby wants to go and have it out with the car dealer, what I want to know is whether the dealer has ANY liability at all, none of us even thought to look at the tax disc on buying the car - this is a long standing garage with a good reputation, you just assume that it's fine.
    At xmas I realised I hadn't received the V5 so I rang DVLA and registered the car, it is in my name. If the car has been unlicensed since the end of last SEPTEMBER, why on earth have they not contacted me about it.
    The whole thing has left me feeling very sick and my daughter was terrified by an event that should never have happened - in hindsight yes, we should have checked the disc.
    I now want to get rid of the car as soon as humanly possible, it's cursed I swear - it's only just come out of the garage after my daughter skidded on some black ice 3 weeks ago and wrecked the bumper - it's a good job we didn't go through the insurance!
    I don't know whether to contact DVLA or not, I'm very annoyed that they haven't sent any reminders or letters as to why the car has been untaxed for SIX months.

    You MUST contact DVLA and give them ALL the details.
    This is fraud on the dealers part (if he knew the tax was dodgy or not). You have to trust some people at some time, and if this is a reputable dealer then why would you look at the disc, you can see the date is in order and that is examination enough.

    You should also make a complaint of your own to the police.
