Well posted my first DPA letter anyway to my local branch. Have not submitted any payment as of yet until I receive some kind of acknowledgement from the bank and to see what they ask for. Guys, just a quick query, once I have my statements, who then do I follow the action through with, Is it my bank or head Office?
drummy - if you havent sent the payment you will not be able to hold them to the 40 days - they could take forever to come back to you to request a payment from you and then the 40 days wouldnt start until they receive it back from you.
Drummy - Doh! Start things off with your branch and keep it there as long as possible, they will at some stage escalate matters to Head Office, but if you deal locally then you can hand deliver your letters and speak to an advisor, make them work for you for a change. I would suggest getting on the phone and speaking to someone about the letter, just on the presumption that they have recieved it. I called the RBS Rugby branch and they said they hadn't recieved my letter (which I then faxed) and would provide the statements for free in about 7 days. If they want payment then take a copy of the template with your details in to the branch with a cheque or PO for £10 (the maximum charge), others have been charged £5 but have a go! Make sure you spend some time reading through the FAQs and get familiar with the templates before you have to use them in 'anger'. Also look through other threads about the RBS/BOS and cut & paste useful advice & phrases for future reference.
If your Branch is local, then drop things off by hand and get a receipt. I live miles away from my Branch but post letters and fax them, then follow up with a 'did you get my letter' phone call. If it gets to court and you can prove that you have followed reasonable timescales and the Bank have messed you around then it can only count in your favour. They WILL try all of the delaying and timewasting tactics in the book and even err on the imtimidation at times, they are running scared and know it....

Ok thanks for the acknowlegements. The letter was sent Recorded delivery and so will need a signature once they receive it. Once I know that the branch has received it, I intend to give them a call to discuss it further. Thanks for the advice.
