Re: GE Money refusal to pay back PPI
I am chasing GE Money for PPI. Basically I had a pre-existing medical condition that was never discussed at the point of sale. Nothing was discussed about the insurance infact.
Recently they have sent the following...
In short form....
1. Thanked me for my letter.
2. Although the sales assistant completed the form - I signed it agreeing to the terms.
3. Advising me that sales assisstants are trained to provide correct information and to ensure that customers are fully aware what they are signing up to! There is no requirement for them to record sales process and that a welcome pack is sent out with a policy and a 30 day no quibble guarantee.
4. Pre-existing medical condition - evidence required by them. "...please be advised that we will reimburse you for any additional charges incurred should we find any evidence of mis-selling".
5. Decision remains the same (not refunding). However, once received required evidence, we will investigate your complaint further and review this decision.
6. Nonsense about if I am not happy contact the FLA.

Can I have comments as I am a bit confused.
Basically on my medical records prior to taking this account out, I thought I was suffering from arthritis. However, recently I have been diagnosed with Parkinson's disease.
Basically they are using delaying tactics as most banks will. I have had the same problem and have been alerted to it. No more Mr Patient nice guy!!
are you aware that GE have already been fined by the Financial Services Authority (FSA) for Mis-selling PPI.

Now I am now familiar with the dates of your loan but the fact they have been fined for mis-selling I would suggest puts you in a strong position to claim you money back on mis-selling grounds on the Pre existing medical condition issue.
Please take time to check out the stickies and other threads, especially any GE threads on the site you may pick up some useful information on proceeding with a mis-selling claim against GE.
Send them a letter from your GP stating when you were diagnosed and what medication you are on etc etc, thats the evidence they require, I sent them a doctors letter and they repaid within 2 weeks of recieving it with 8% interest and a loss of cash premium.

I have only just got round to it as my Parkinson's deteriorated. Put it in post today - I will let you know the outcome. I have sent copy letters from my Neurologist to my doctor and a professor up in London. Hope this is enough proof.
It should be more than enough evidence.

just had a thought about the above quote.
Firstly I know you are proceeding down the pre existing medical avenue.
The para 3 as quoted above smacks of fob off.
If there is no requirement for them to record the sales process how can they be certain the sales process was followed? and accurate? The 30 day no quibble guarantee was probably in very very small print at the of page ? just to make sure it was overlooked or missed.
If they have no written proof of the demands and needs details which is a requirement for the selling of PPI. How can they provide evidence that they followed the correct demands and needs procedures?
When determining whether a policy is suitable, a seller – whether a lender or an agent for the insurer – must obviously take into consideration any information the prospective policyholder volunteers. However, we do not consider the seller’s duty is limited simply to recordingwhat the borrower discloses. It is only by asking questions that the seller can properly determine suitability. These questions cannot cover every aspect of a borrower’s personal position and should not be expected to do so. To paraphrase the ABI Statement, only those matters deemed to be relevant by the insurer should be the subject of questions.
Just checked my account with GE Money and was to pay off small amount and it was already cleared. Checked transactions and looks like I have a cheque/BACS payment on its way - yipeee I can sigh with relief.
If any mods read this can have something stickied about doctors letters being sent to creditors regarding pre-exsisting medical conditions? it seems to have the desired effect on most creditors Black Horse not being one of them may I add!
