    Default Problems 'challenging' a credit file entry!

    Hi folks,

    Ive got a big issue i feel completely frustrated and helpless with. I have a copy of my credit file which shows a default placed against me from a collection company called Cabot. They were dealing with a debt from Capital Oneicon for about £200 when i was a uni student.

    I havent ever known (honestly) anything about this default and cant even remember the debt! Thats not to say it didnt exist though. I had several cards at one point.

    Anyhow I contacted cabot and requested the info under the CCA and payed the £1 fee. They returned it stating they do not accept the fee and cannot help. They told me to contact the original debtor for the information, BUT it is Cabot who has entered the default?! Surely the default cannot be legit and remain in place if the company who placed it cannot provide me with the info why?

    Anybody have any ideas on this? I'd appreciate your advice.

    If you defaulted on the debt, they are entitled to record that on your credit report. How long ago was this? After 6 yearsicon the default will automatically drop off the credit.record

    Thats just it, i dont remember defaulting. At the moment i'm trying to get the details of the default, but the entry was made by Cabot, yet they are telling me they cant help and i need to contact the original lender. In which case why did the original lender not add the default entry.

    One company tells me to approach the other, but Capital Oneicon tells me i need to deals witht the company who made the entry!

    It was about 4 years ago now

    Hi you do need to deal with company that made entry and ask then for copy of default that was sent. I would ask who their governing body are and if they have not adhered to cca or data protection act you can claim damages...

    Hi, Cabot entered the default. The debt was originally with Capital Oneicon. I sent Cabot a CCA request and fee, but they've returned it and said they do not accept the CCA! How can they not accept it?! They also said the matter should be taken up with the original creditor.

    I just dont know what to do now!

    try and find out who cabot are governed by and give them a call or maybe even call information commissioners office and ask for some advice...
