    Default Help for my Mum please with GE Capital PPI

    Hi, My mum has had a GE Capital Store card since 1994 with had PPIicon applied to it. When taking the account out mum only worked 7 hrs per week - and suffered numerous medical conditions. Over the following years mum has had several health issues repeatedly ending up admitted to hospital and off work for some time. It is only recently that this PPI has come to my mums attention to mention it. We wrote an initial letter to GE and have had a typically unhelpful reply.
    I am wondering if the working only 7hrs per week and the health issues involved mean that it was mis sold. As usual the cover was taken out (most likely) with a one line sales pitch from a sales person in store which is neither trained or qualified in insurance.
    Please help- what is our next course of action. We will send a SARicon this week so that we can calculate the amounts involved

    Hello SS!

    I'd also send them a request for a Copy of the Consumer Credit Agreement (CCA) as well. Fee for that is just £1. They have just 12 Working Days to produce it.

    It may be that they have no enforceable Agreement, but the good newsicon there is the short timescale of 12 Working Days to produce the CCA, could allow your Mum to have the Account firmly in dispute sooner by also asking for a CCA. After 12+2 Days they cannot ask for Payment and you do not need to Pay them until they do produce a valid CCA. They can't add interesticon or any Charges either. They then have one Month or 30 Days to produce the CCA or they are in more serious trouble.

    By all means send them the Subject access requesticon (S.A.R.) and £10 fee, but that gives them 40 Days to respond.

    It may be better to do both, but the CCA may help to get things into Dispute initially, and then you can look at the options. Such as stopping Payments while they get their act together, if that is suitable.

    Might also not be wise to start making Claims until you know if the alleged Debt is enforceable or not. Making a Claim may help to validate the Debt by admitting it exists for example.

    The key is to gather the details steadily, and Plan, read the Threads here, and Plan, read more Threads here and Plan. And did I mention Plan?

    I'd also send them the Telephone Harassment Letter as well, just to stop any nonsense with them trying to hassle you and/or your Mum via Telephone.
