    Default Parking in Lambeth

    Hi
    Just received a notice to owner dated 20/3/08 for an alleged offence on 11/2/03 under the RTA 1991 (as ammended).
    I was parked in a pay and display bay with a ticket valid until 12.38. I returned to my vehicle to find an attendant filling out a ticket and I questioned him as I was only 4 minutes over. he replied that Lambeth only had a 2 minute leniency. I got in my car and drove off believing that unless the ticket was handed to me or fixed to the car it was incorrectly issued.
    I have never received the ticket in the post so was suprised to receive the notice to owner requesting £80.
    Having looked at the RTA of 1991 it clearly states the pcnicon should be fixed to the vehicle or given to the driver. I understand things have changed now and that these can be issued by post.
    How do I stand with this? I have sent the form back stating the PCN was never issued to me either by hand, attached to the vehicle or by post and have requested either photographic evidence of the PCN attached to my vehicle or proof of delivery to my address.

    Your thoughts would be appreciated on this matter, I'm glad I found this website!

    The ticket should have been placed on the car prior to today (or handed to you). You can contest the PCN on the grounds it was not served correctly, the Council will obviously side with the PA and say it was unless the PA has not made the correct notes regarding its service. The next step would be to appeal to PATAS who will decide who to beleive based on the evidence before them.
