Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
I received a pcn from our friends at Civil Enforcement Ltd for £150 for overstaying my welcome at the kfc in Barnsley. Now i was going for a job interview at Iceland that day and after driving around thought there would be no harm in parking there (i did get a coffee!) and there was no ticket on my car when i returned back!.I stayed for 1hr 33mins.
Now 10 days later i have received this letter through the post stating i breached the limited free stay allowance (which i never saw).
I have read the other posts on this but now cannot find them hence me starting a new thread!.
Should i do what everybody else has done and basically tell them where to go?.
I offer help and advice in good faith, based on my knowledge and experience. I am NOT a legal or financial expert. There are many CAG members and site team who are better qualified. Hi im new to this forum!.
I received a letter in the post from our friends at Civil Enforcement Ltd regarding me overstaying at a kfc in Barnsley
I had gone for a job interview that day and parked there as the car park across the road looked like the sort that i would come back and find my wheels missing!.
Anyway i was gone 1hr 33mins,came back and all was well until i got this!.There was no ticket on the car at the time and i never noticed any signs stating how long i could stay,to be honest i didnt look.
They are saying that i have breached the limited free stay allowance and they have photographic evidence of this which of course will cost me £10.
I have read the other threads regarding this and should i go down the same route and tell them where to go?.The charge is £150 (reduced to £75 if i pay early)
Please help!

Gra, Welcome to the Parking Forum.
CEL well known on here. They seem to have cornered the market in annoying people at fast food outlets - KFCs, McDonalds and the like.
The main thing to remember is - DON'T PAY - This is a [problem].
The 2nd thing to remember is DON'T PAY - This is a [problem].
These tickets are based on alleged contract law, they are nothing to do with "official" council penalties. You can either ignore or use Bernie the Bolt's template letters.
I've attached the relevant links below but the main point to remember is that any contract would be with the driver. CEL get Registered Keeper details from the DVLA [an outrageous abuse but the DVLA get £2.50 a go for this, which adds up to £Millions a year for them]. The problem is who is say that the Registered Keeper was driving at the time? Certainly not you, you would be under no obligation whatsoever, so keep silent on the issue. A 2nd problem is the issue of penalties, these are unenforceable under English law. Excel [another big private parking company, came a cropper on this issue earlier this month, losing a well reported case.]
With a company like CEL, there have been hundreds of postings, no one has heard of a court case. With the drubbing that Excel got, I can't see CEL going to court now. Ignore completely or use the template letters, it is your call. Whichever choice you take you will get pure BS through the post, threatening legal action, bailiffs, bad credit rating and so on. It is all pure Bull. These companies are pretty persistant, it may take 6 or 7 letters before they get the message and give up.

Thanks very much Barnsley Boy!.What i am concerned about is the photographic evidence they claim they have and could this prove this was actually me driving the car? Also as my licence is in my parents address and i have not informed the DVLA of my address this went to my parents house.Should i inform them of my new address in any letters i send or not?.Or should i just keep with my parents address?.Not sure whether or not i should write to them anyway, what is the best option, ignore or reply?

Having a photo is one thing - finding out who the person in it is something else. Often the photo is of the vehicle not the driver. Even if they can prove who the driver was it in no way invalidates your defense that the charge is a penalty and/or that it may be an unfair contract term.

As to the address - I would write using the address they have used in any correspondence.
There are two trains of thought as to whether to reply or not. One says that should the matter come to court it will be useful if you can show that you tried to resolve the matter beforehand. Replying also puts the PPC on notice that you know what you are doing and that they haven't got an "easy mark" on their hands. On the other hand some posters recommend that you ignore everything short of a court summons. The outcome is usually, more often than not, the same. It really depends on what you are comfortable with.
they have photographic evidence of this which of course will cost me £10.
So remember the next time you mug someone, have a tenner in you pocket when you get arrested so you can see the cctv of it.

Thanks mate
I was so close to paying this as well until i thought i would check these guys out on the internet and thank god i did!.
I did think the letter i got was a bit dodgy, for example the address of the offence just says "car park on peel street" which could be anywhere.
I would imagine there are lots of people who have just paid this just to get rid of it (i was nearly one of them).
Still not sure whether or not to write now or wait for an actual letter the point being from what i have read they just seem to ignore these letters anyway.
The photographic evidence did worry me as i had visions of pictures of me getting in and out of the car!.
It wont get that far Gra. They will bug you for a while and then go away.
Just take note of what pin1onu says, and have faith.
If you should write, ask them if the pictures come in a frame.

I hope we've convinced you - now tell ALL your friends and family. No one should pay these bogus tickets believing that they are in some way "official". the sad fact is that hundreds of thousands every year do.
