been a intermittent lurcker on the site for an eternity it seems before finally deciding tomake a concerted effort to claim these blasted charges back from 2 credit cards that I used to hold with B/card from 6 years back.
Well, firstly, do not know why I ever waited and procrastinated for so long? Followed the excellent guidance, commentary and various templates etc here and even had the bonus of 2 sets of statements sent for the sum of £10 from one B/card Visa and one B/card Mastercard.
The lba that was sent regarding the Visa account recieved a response yesterday (all within the given timescales and with Easter as well....almost impressive from them...):

I write further to the complaint you raised with regard to default charges applied to your account.
I am sorry that this matter has not been resolved to your satisfaction. I have reviewed your complaint and detail my findings below.
Our understanding of your complaint:
You feel that the charges incurred on your barclaycard account are unfair and you have requested a refund of the charges plus interest.
Background to the events leading to your complaint:
Following publication of the report by the OFT, Barclaycard reduced our fees to £12 with effect from August 2006. Therefore, we agreeg to credit your account with the difference between the charges that you incurred and £12.
Having checked our records, I can confirm that you have been charged fees totalling £XXX.XX we refunded XXX.XX of these charges.
Summary of our Internal Investigation:
In the circumstances, as a guesture of goodwill, I have credited your Barclaycard account with a further £XXX.XX representing the remaining charges and £XX.XX interest, calculated at 8%. However, we believe that our charges are fair and reasonable.
I am sorry if this is not the outcome you waqnted, however, I hope my explanation is helpful. For the purposes of the Financial Ombudsman Service you may regard this letter as our "final Response" to your complaint.

Appears to be the standard default response at the moment. Due to the way the letter is word though, can I just do a reality check with those that may care to comment???
The letter suggests that a partial refund of charges incurred are given(?) i.e. let's say £30 minus £12 so that £18 is the given refund per charge but as their gesture of goodwill, they will give the £12 as well so in other words I get back all the charges + the 8% interest - am I correct or missing something very obvious?
Second question - there is no mention of a requested removal of default notices associated with each time the charges took me over the limit or when minimum payments I made did not cover the combined charges - can anyone advise how this typically getting resolved (or not?)
Third - the Mastercard process was identical but as it was lagging 3-4 days (due to when the statements arrived) should expect a similar final offer letter imminently, would you expect it to be exactly the same as above?
Any thoughts/comments most welcome, this could be a very short thread... thanks in advance
I'm dealing with them at the moment, and they have indicated Credit Cards are not part of the 'test case'. So as off yesterday they were getting in touch with HBOS for me, regards my Visa Claim.
They have just got HBOS to settle my Business Account claim, I had only claimed £3,000. as I only went back five years as I live in Scotland, but FOS said they always tell the Banks to go back six, and HBOS gave me £4, 945.00.
And the good thing about the FOS route, it does'nt cost you a penny.(well maybe a stamp)

Visa a/c - You're not missing anything - BC have offered a full refund of the chgs (including 8% s.69 int't which they don't have to pay before you file at court) because they know they'll have to repay them. This saves them court fees and the costs of attending court.
