    Question Banks not cashed cheques

    Hi
    Has anyone had this problem we sent out letters for statements of charges over 2 weeks ago. Today I got a bank statement and neither HSBCicon or Lloydsicon have cashed the cheques we sent for the statement
    Is it unusually for it to take this amount of time before they cash the cheques.
    I wonder if they are just taking there time and waiting until nearer the 40 day deadline.

    It's worse than that. The 40 day clock doesn't start until they receive payment which they will no doubt argue will be when they cash the cheques. Did you send your letters recorded delivery or do you have proof of postage?

    Surely they received payment when they received the letter (two days after posting is assumed to be the norm). If they choose not to cash them, that is their own choice as has no bearing on the start date.

    Halifax joint a/c new charges £1100 - LBA sent 02/08/06
    Halifax 2nd a/c (£1500 charges + £150 interest on charges) - partial payment received 13/07/06 (no s69 interest) - AQ filed 07/08/06 - Court awarded 50% of s69 interest (Bank didn't turn up!)
    Halifax Visa (#1) Data Protection Act sent - statements arrived - £350 so far
    Halifax Visa (#2) Data Protection Act sent - refunded £170

    If they want to be difficult they could say that they never received the letter or payment. It comes down to your word against theirs and in the meantime the days tick by.

    Proof of posting or recorded delivery leaves them very little wriggle room.

    Been very green at this we didn't get proof of posting, we'll never send anything again without proof, lesson learned!

    I was thinking of cancelling the checks and re doing the letters then sending recorded delivery.

    Anyone any thoughts on this

    For goodness sake don't do that, as when it goes missing (which it probably will) you'll be out of pocket.

    Recorded is *not* for sending cash or valuable items. Use Special for that. If you can't send a cheque, send a postal order.
