    Default Advice on DCA to accept payment? :-?

    Hi All,
    Just want to say what a great site & Thank You all so much.

    I am currently trying to re mortgageicon and experiencing problems due to my credit score.

    I defaulted on my HSBCicon credit card in May 2005, this was passed onto MCS then Marlin Financial Services last year. The balance is still outstanding (£3000), some of which were charges. I am currently paying £10 a month and have offered to clear the debt by offering £1500 as i am a single mother with a p/t job. They point blank refused and said that they would not accept anything below the full balance and now may look into putting a standing charge against the house.

    I was advised that having the debt 'Settled' on my credit file would mean that less lenders would turn me down for a mortgageicon. I'm so worried that when my fixed rate deal comes to an end that i will fall behind with the mortgage as its going from 4.9% APR to 7.5%, and that having a standing charge would get in the way of a mortgage.

    Please can anyone help, however small your advice, anything would be appreciated. Thanks

    Don't have any more dealings with them over the 'phone... as they will tell you all kinds of bowlarks. They can only go for a Charging Order after first obtaining a CCJ against you.... and can only enforce a CO when you have defaulted on payments under a CCJ.

    As this account is now with a DCA (debt collectorsicon)... you really need to do a CCA request to find out if they even have the right to collect in it in the first place.

    Creditors and DCAs - Letter Templates & Budget Planner

    Letter N.... enclose a PO for £1 (not a cheque)... do not signicon it, just initial it... and send of by rec delivery. Keep the receipt.

    If they 'phone you, just refust to go through "security" or just hang up.

    A CCA request is a legal request for a copy of your Consumer Credit Agreement and they have 12 working days from receipt of it within which to comply.... or you can legally withhold all further payments until/unless they do.

    These poeple are bullies, have you CCA'd them yet?....

    BTW your mortgageicon lender may offer you a deal if you threaten to move to another lender,most lenders dont have issues with defaults when the loan to value is below 70%.

    Shaff - hubby and I are unfortunately being hounded by Marlins too and they threatened us with a Charging Order. We CCA'd them and they are now in default, and have had no correspondence or calls from them for a couple of weeks, the last was a letter after they received the CCA request putting in writing that they are considering a Charging Order. Nothing since we ignored that letter.

    Please CCA them and see where it gets you.

    Hi there,
    Got a letter back from HSBCicon bank replying backs to my SARS request,
    they have asked me to to sign a letter to verify my identity??
    I have previsouly sent off for bank statements and never been asked this before, i am also very worried that i have sent a CCA request off to a DCAicon who now has my account for the HSBC Credit Card and i know for a fact that they will not be able to produce an eliglble copy of the true agreement, and they might forge my signiture

    PLease Help
