Hi everyone, having received a pcn at the end of last year I came to this forum and following all it's advice and template letters I am at the stage of having received 2 letters from Eurocarparks and recently 1 from the debt collection agency. One point I am not clear on though is that in the unlikely event of being summoned to court would it be the debt collection agency or Eurocarparks who would be the complainant?
Who are the debt collectors, is it "control account". If so they are just acting as agents for euro car parks.
Sometimes debt is sold on, more usually when a company goes bankrupt such as BPM / CRS [see thread].
Debts Collection Agencies usually just act on behalf of companies, creaming off a percentage for every penny they get from punters. They are meant to do this fairly and honestly in accordance with debt collection guidelines as set out by the Office of Fair Trading.
If you want the Debt Collection Agency to stop writing to you, write back to them, denying the debt and insist that the matter be referred back to Euro Car Parks.
Thanks again Barnsley Boy, youre right it is control account. They have written as they have firm instructions to commence litigation blah blah blah which is why I wondered wether they had taken over the alleged debt. I have written to them telling them to refer the matter back to their clients but no doubt I'll get some more bumph through the post.
