Been approached by one of my wife’s mates (no sniggering at the back!!), She took out finance last April for a new Ford at Evans Halshaw, The finance was thru Evans Halshaw with Blackhorse finance, The screen price was £12000, she traded in her old car for £4,400, so the actual finance was only £7600, The agreement that she has from The dealer has not been signed by her, it has been signed by the salesman in the place for his signatureas he should and he has signed HIS name where hers should be. According to the dealership the outstanding amount is about £12000 inc interest
, Now this is where it gets complicated.
BHF has also sent a copy of the paperwork and again none of it has her signature on, its the same as the agreement that EH supplied, BUT they say she owes around £15000, she has informed Blackhorse that this does not correspond with what EH says she owed but BHF say they stand by the amount of £15000,
The lady still wants to keep her car but how do we proceed, I know if we issue a cca request the paperwork will not have any of her signatures on it. Of course the Finace company cannot legally enforce the finance as far as I am aware as they wont be able to supply a true signed copy of the agreement, but She cannot say she doesn’t owe the money cos she is riding about in the car, What would be the best course of action, ultimately she wants to keep hold of the car.
Any help would be appreciated
