have wirtten to studio to ask for the return of PPI which wasnt ever agreed to and amount to a tidy sum.
i got the usual letter back - you agreed over the phone, it was all explained to you etc etc - and i wrote back telling them there was no way i would ever have agreed to it because i am a housewife, have a pre existing conditon etc., so would never have been able to have a claim. i then went on to say that if they say i still agreed to it then they would be pleased to send a me a copy of the signed agreement agreeing to this.
had a letter to day saying that it is a verbal agreement and because of the things they said in their first letter to me, they do not agree and the claim is not upheld. what do i do next please??
This is a legal request within the terms of the Data Protection Act 1998. If the request is in writing and accompanied by the correct fee, the organisation you are requesting the information from have a legal obligation to reply to your request. If they do not then they are in breach of the Data Protection Act 1998 and you can then take matters further.
The information you request in your SAR should include transcripts of all telephone conversations as in your case they state it was a verbal agreement. Let them send transcripts of the telephone call to prove that statement.
If they refuse or do not respond within 40 days then list another post. In the meantime if you get the chance check out other threads in this forum and links for the official advice from the relevant authorities.
