Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
Hi, This is my first post. I was told about this site by a friend and am not too familiar with how all this works so I'll come straight to the point. For the past 12 months I have been really struggling to keep pace with the bank charges which A+L have been levying on my current account - £1300 pounds in the last 8 months! The charges have been mostly failed direct debits, going outwith my overdraft etc. I have been caught in a cycle which must be familiar to many and have been given no help from the bank. The bank have now closed my account and are demanding settlement of outstanding overdraft and fees to the tune of £950. I can't pay this and am at my wits end. My major immediate concern is my mortgage which is also with A+L. I am not in arrears and never miss payments but my question is this - Can A+L take action against me like repossessing my home, adding my bank arrears onto my mortgage or anything like that??? Apologies if that is an absurd and unfounded fear but as a single father of 2 young children I am really worried and would appreciate any help and support that anyone can give. Thanks.
1 DON'T PANIC
2 read the FAQ section
3 remember there are lots of people here who have been in the same situation. It's a bit quiet at the moment due to the test case but people still pop in and check the posts.
Apart from the mortgage that is the same situation I am in. Did they give you any notice when your account was closed?

Personally no mortgage - but I am claiming £4G from them about 4 months before they closed down for the test case.
You MUST read the FAQ on all sites, they will help you understand you are not alone.
They will also help you to put your personal bits into perspective - never mind what the Bank says, you always have an option.
Start a spreadsheet or an HTML .DOC file (with Links) if you are up to it.
You will have so much information hitting you that you will feel overwhelmed but remember we (some) of us are always here to help you along.
Put this into perspective - even if I lose - I have gained 3 years and made them wait 2 and not default against me - and even if they win - I pay them £5 a month.

PS
Even if you were my worst enemy, I would still help you when you are up against the big boys - and so would everyone else on this site.
Loz - no, they gave me no notice whatsoever that my account would be closed. They just sent a letter saying they had done it and would be issuing a default notice in 28 days if I don't pay the full amount outstanding. They cancelled all my direct debits and standing orders which has caused me a load of grief. Every month I bring my account back within the limits of my authorised overdraft but then they add the charges on and put me over again!
Duncan,
That's exactly what they did to me, I didn't find out until I got a nasty shock on pay day. Make sure you submit a written complaint to A+L, pointing out that they have breached both the Banking Code and their own T&Cs which state that they must give at least 30 days notice of account closure. I don't expect they will pay any attention to your complaint but once you've got their final response (or 8 weeks silence) you can go to the Ombudsman.
Good luck!

Hi
I have had the same as well. Account closed without notice on pay day and they refused to give me any money as they took it in charges. When i went to the branch they said the account was pending closure but when they phoned collections for me they said the account was closed, changed over 3 mins!
When cab spoke to them next day A&l said the account was closed to me but open to them!
I put complaint in to the legal department in Sept and got no reply and then put complaint in to fos. I haven't heard from them either yet!
A&L stopped me from having any access to the account so I can't even check the statements! They also told cab that I had to pay £75 a month for 6 months (although there was no debt on the account!) to put my account in credit and then ask them nicely to let me have access to it again!
Good luck
