    Question MBNA sold me a credit card PPI when I was a student

    Hi guys,

    I'm new to this forum, but after reading lots of your success stories I feel a bit hopeful about reclaiming my PPIicon balance from MBNAicon. I was going to post this in the student forum, but I thought it would be better suited in here, as it covers part time work too - but if I have made a mistake - apologies mods!

    I was studying full time at university from Sept 2004 - June 2007. In May 2006 I applied for a MBNA credit card and of course, a PPI. I was working on the weekend also, but under 15 hours a week - though, again, there is no mention of part time work being excluded from MBNA.

    There is no mention of student exclusion in the T&C booklet, however I've seen on this site - Reclaim your PPI premiums - payment protection insurance | This is Money that it's common that students are not covered, however in this case, as it's not mentioned in the T&C - I'm confused. At the time I was working on the weekend also, but under 15 hours a week - though, again, there is no mention of part time work being excluded from MBNA's PPI.

    I was thinking of calling MBNA, posing as a new customer and asking one of their team weather students are covered under PPI. If so, then there's nothing I can do I suppose, but if they are not my first step would be to lodge a Subject access requesticon and go from there.

    This is the first time I have embarked on such an 'adventure' and if anyone has any ideas or advice - I'd be grateful to hear from you.

    I just called MBNA to cancel my PPI - the CSR told me the office was shut and gave me the number to call tomorrow, also asked for back bank statement, again, same story - office closed.....and then she asked me if I'd like to buy fraud protection cover! UNBELIEVABLE.

    Hello golden-spiral!

    If I were you, I'd tackle it like this:

    (1) Keep everything in Writing, and never speak to any banker, and especially the MBNAicon, via Telephone.

    They are not your friend, and being tempted to resolve things by being nice and polite to them via Phone will just tease you into some little trap or dead end of their making. Their staff spend all day on the Phones, after all, so they've had plenty of time to prepare the ground and catch you out.

    The phone is not accountable, unless you have the equipment to Record everything and the verbal confidence to outwit the outwitters.

    (2) Write in and Cancel the PPIicon ASAP, just to stop any further of your hard earned Cash going the MBNAs way.

    (3) Go for a Subject access requesticon (S.A.R.) using the Template Letters you will find in this Forum. There are a few, so aim for the one that asks for everything, including Voice Records, notes when your Account needed manual intervention, that sort of thing. They have 40 Days and it will cost you £10.00.

    (4) In that time, bone up on PPI mis-Selling, and plan.

    Others will no doubt jump in to help, but the above may set you off.

    Hiya BRW -

    Thanks for your advice and reply!

    I stupidly have already cancelled my PPIicon on the telephone, but I will send out a letter today asking for closure.

    The CSR said that as a student in P/T employment, I was covered as long as I paid Class 2 N.I, and I just called up the National Insurance office, and according to their records I paid £4.48 that year for National Insurance, which obviously indicates that I was working part time at a low wage (student life, eh?). They are sending me a statement to that effect (should be here in 3 weeks)

    This shouldn't damage my claim right? Even though I did pay N.I that year, I still feel MBNAicon mis-sold me my policy, as for a large amount of that year I wasn't paying NI, so I woulldn't have been covered anyway - I mean, you can hardly pay 37p a month NI!

    I have also used the template for the SARicon - and I'll post that out today too, I will send these registred post, with a postal order payable to MBNA.

    Good luck with your noble goal - I'm gonna keep an eye on your thread and my fingers crossed that you prevail!

    Hello golden-spiral!

    It's starting to look like you were mis-soldicon, but keep gathering the Ammunition for now. The Subject access requesticon (S.A.R.) may well arm you a little better, as it can provide added munitions!

    One caution, some of these money-lenders and/or debt collectorsicon have, I understand, been known to re-create past Agreements using glue, a photocopier and recent scanned Signatures. So it's a wise precaution to deny them a current crisp copy of your signatureicon when writing to them.

    Either do not Sign anything, or take steps to make it harder for your Signature to be used. Say, by writing your NAME OUT IN ONE COLOUR, and then Signing over that in another. Use lurid and clashing colours that will rat up most low end scan attempts. Perhaps also add a little something to show you it is not your usual Signature, an extra Dot or little dash somewhere. A little extra that will alert you when you see it again later!

    Afternoon BRW,

    Thats's a grat tip - I've signed both letters in a completely different and (illegible) way,so I'll definately know if someone tries to 'Blue Peter' my credit document. I would have made a retinal burning colour clash, though sadly my office stationery cupboard doesn't extend to exotic chades of pink and green

    Hello golden-spiral!

    The trick is to make sure the signatureicon gives them enough to show it is you validating the Correspondence, but not in such a way that it hands them a usable signature on a plate!

    Best avoid being too drastic with the changes, or else they could say it looked too dubious to act on. They may argue it looked like an identity thefticon Letter clearly signed by someone else...and use that as an excuse to ignore whatever Letter it was you were sending them.

    It's a bit of a fine line, but I think you get the drift.

    Just keep it close enough to your own Signature to validate whatever you are sending, but with little tell-tales that will show it was a subtle variation on your normal sign-off. The clear purpose of which you can later demonstrate was to deny them a chance to see a virgin copy of your Signature that they otherwise would not have had (having Lost your CCA or other Key Documentation)!

    If this latest Signature then pops up on older Documents, you will then have nailed your money-lending rat. Or at least revealed the type of people you are dealing with, which might just amuse a Judge in the middle of reviewing your other winning evidence.

    Go for it, and beat them into submission.
