My Barclays case was stayed in August of 2007, my claim was for around £2500. Since August last year i have had a further £510 of charges applied to my account which i am frankly appalled by. Is there nothing i can do about this, it seems unfair that my case has been stayed due to the test case yet the bank has carte blanche to continue charging. Barclays have also threatened to close my account as i have been over my overdraft limit for the last 13 consecutive months.
Basically there's nothing you can do until judgement on the OFT test case is handed down, which the OFT are not expecting till end of July at the earliest.
Once stays are lifted, at that point you can amend your claim to include the more recnt charges
But if the banks are given a reprieve until the test case is resolved shouldnt it be both ways, i understand they are going to continue to charge until being told to stop but if a case is on hold surely the courts should 'stay' their charges. Surely the case should be allowed to continue if the charges are continuing !???

You think that, I think that. The reality is, unfortunately, rather different.
I have wrote letters for refund to Halifax as described, but haven't registered the case with court as yet, what should I do now due to circumstances with stay etc?
