Hi, after reading loads and load of threads I am hoping someone can advise on a problem I have with a car finance PPI
I returned car to a company called Direct Auto finance as wanted to replace the car with a better one. They gave me a final balance and instead of paying in full as it was high I decided to opt for voluntary termination.
I opted for PPI as was told I had to take it out or couldn't get the finance with them back in 2003. I also believe I have loads of charges from letters and calls due to late payments which in fact made the final figure given to us much higher than what it should have been so might not have needed to give the car back. Since the car was handed back I immediately took another car finance with another comapny (no PPI!!!) and have not missed a single payment even though the amount is higher so I cn prove it wasn't given back due to financial difficulties
Can anyone advise what to do regarding the PPI paid as due to the amount there is no way I would have taken it out had I been given the choice. Also I have been told that the initial deposit I paid should not have been put on the PP insurance side and that this is an error on my contract.

Best first move is to send a SAR to the company and get all of the info they hold one you.
You will find the template letter in the ppi stickies, copy amend to your details and send it recorded delivery, with a £10 postal order, they have 40days to comply.

I would sent it to the original creditor.
Has the debt been sold to the DCA or have they just been instructed to pursue it?????

I don't know to be hoest but have been receiving letters for a long time from DLC. It used to be Red that sent a few offereing a reduced amount which I ignored. DLC have been writing and phoning for about 6 months now.
Everytime I ask DLC for various documents they just send the balance of statemtn - not a Breakdown and a copy of the contract which they like to colour in as well! I don't think they have the details I want so I was wondering maybe I should send the SAR to Direct Auto Finance and a letter to DLC advising of this.
What is the best way to deal with this as I'm really angry and upset over this - feel totally conned. DLC are also claiming this was a repossesion when it was in fact a voluntary termination as we had paid 2 thirds of the car and were up to date at the time of the handover
All I want back is the PPI I have actually paid to be refunded. I am confident once the charges are shown that if unreasonable - if a reasonable amount can be agreed (what is reasonable?) minus the total PPI I feel I was misold, this would leave a balance in credit!

Ok there are more ways of tackling this problem. Send the original creditor auto direct the SAR and a request for a copy of the credit agreement under section 77/78 of the consumer credit act.
Send the DCA a section 77/78 request for a copy of the ca as well.
You mention that this DCA has been hounding you for about 6months, You now need to log all telephone calls and keep all letters of communication from them. When they sent the first letter to inform you that they were after you. what did it say,
They were instructed by auto direct??????? Or they had been sold the debt, this is important to know:grin:

every time I ask for certain detials - ie charges, insurance policy details, Breakdown of how the amount they are saying I owe has been calculated - DLC then send me a copy of my contract and a balance of statement which just shows payments made.
I have a letter from them which says is a repossession when it wasn't and I have read elsewhere that this has happened to other people so I guess they treat everyone the same sending stupid responses in their letters.
I think they have sold the debt to DLC as I have been told several times by DAF to speak to DLC despite the fact that DLC cannot answer any of my questions regarding the dispute
