    Default Insurance producer problem

    Hi! I wonder if I could just put a problem to the forum. Basically my better half was driving in London (we live in Nottingham) a couple of months ago and was stopped by the police (a defective rear light). Essentially she ended up being asked to produce her documents. As she was there for the day she arranged to produce them at a Police Station here in Nottingham (which she did the next day). Fast forward to last Saturday and she recieved a summons for failing to produce her documents.

    Questions - should we just respond to the court summons and attach the relevant documents or should we write to the court, explaining the circumstance. Also is there any point in having the case transferred to a local court?

    Any advice would be valued.

    Why don't you go to the local Police Station and ask why you have been summonsed despite attending the station with the correct documents?

    when you produced, were you given a type of receipt? did you keep it? I would in the first instance, go back to the police station with it and ask them to check that they still have their copy, under no circumstances give yours up.

    Then I would ring or write to the person who has taken out the case (the must be some contact details on the court docs, if not, ask them to get them from the N1) and inform them of their mistake, please keep up updated. It is probably just a clerical error that can be cleared up in no time at all.

    Lula an N1 is used to issue proceedings in the county courticon. The OP needs to contact whoever has issued the summons and also the local nick that they produced their documents at.

    I believe that the OP's OH, has received a summons to go to court, I dont know how the police do that but I would have presumed that they would have had to file something with the court first and that would have some contact details on it, for whomsoever had processed it, they can then point them in the direction of the copy on file that should be at the local nic, or just send a photocopy of the receipt.

    This is a common problem with HORT1 forms (commonly called producers).

    Usually what happens is that the person issued with a HORT1 takes it to their local police station which is usually with the same police force that issued it.

    The problem here is that it was NOT with the same force so you are reliant on the station you produced your documents to sending the paperwork to the station (or force) that issued the HORT1.

    I suspect that when you attended the police station to produce they simply recorded your details, gave you your documents back and you left, It isn't usual practice to give MOP's (members of public) any written confirmation to say that they have produced their documents.

    I would also suspect that you have been summoned for failing to provide details.

    What you should do is go to the station that you produced your documents to and explain the situation to them, ideally ask for the Duty Inspector and explain the situation, ask him (or her) to check in their records (you will need to work out when you attended) that they did send the details to the force that issued the HORT1. Also get a note of their name and their number.

    Then contact whoever issued the summons and explain the circumstances, also follow that up with a letter confirming the conversation.

    Ideally the summons should be cancelled, if it isn't and you need to attend Court you have a very reasonable argument for costs
