    Default FPN for not wearing a seatbelt even though i was

    Just after a bit of advice,

    I was stopped yesterday and one officer said i wasnt wearing a seatbelt and the other said he thought i was on the phone. I was actually wearing my seatbelt and wasnt on the phone. The problem was i have recently broken my collar bone and by habit had by arm across my shoulder when i drove past a parked traffic police car.

    Anyway, both officers were immediately very aggressive and asked what i was doing.. When i gave my explaination the one who thought i was on the phone was fine, but the other officer was very cocky and insisted on giving me a ticket even though his partner couldnt be sure i didnt have my seatbelt on.. He even said to him, you'll have to give him a ticket as i didnt see anything... Is it worth going to court as its only £30. And dont all traffic police now have on board cameras so they could check..

    99% of traffic officers have some sort of video kit in their car. It may of been recording, it may not have - you wont find that out till you get to court usually.

    You can elect for a hearing, and the officer will put a file together for the court, which you will get copies of when you get the summons through. This will include his statement, and detail any additional evidence (his statement will detail any video evidence).

    For £30 though (apart from the principal) - is it really worth it ?. It will cost you more of your time to get to the court, take a day off, and at the end of the day, its your word against the officers. Taking something like this to trial will almost certainly end up with you having to pay more.

    You may win it, but if you loose, it becomes a driving conviction, which you have to declare to insurers and the like. Also means you appear on PNC - which might mean any future 'errors' in your driving result in a ticket, rather than a telling off. I know it shouldnt be like that, but it is !.

    While I sympathise with your situation I would think through how you would answer in court why you felt that you were fit to drive with a recently broken collar bone that results in you, by habit, not having both hands on the wheel.

    Precisely.

    £30 for no seat belt as opposed to a court summons for not being in full control of the vehicle.

    cheers chaps,

    thats what i thought!! The most annoying thing was the shocking attitude of the young officer in question that gave me the ticket that wound me up even more, talking to me as if i was a 16 year old scum bag!! Add this to the fact that i was actually wearing my seatbelt, Also the fact that his collegue tried to talk him out of giving me a ticket because he wasnt sure... unbelievable...

    Anyway will just pay to save the hassle.....
