    Default Parking Charge

    I asked the question at the end of a previous thread and although I got an answer from Barnsley Boy I just wanted to make sure whether I should ignore it till I get further correspondance or contest it straight away as they put an incorrect date on so I can declare i the car was not at the scence of the incident at the date and time they claim

    Don't initiate any correspondance with them. It costs them £2.50 to get Registered Keeper details from DVLA, let them incur this cost.

    Use Bernie's template letters as below.

    Am in a bit of a predicament with this one. My boyfriend was driving the car but inbeknown to me at the time, his dad is actually the RK of the car. When his dad received the letter from the PPC, he knew the date they had put on the original ticket was incorrect (a day earlier than was parked there) so said on the day the car wasnt parked there.

    However, the date on the letter of the offence said the 26th which was the day it was parked on the land. His dad just automtically presumed the date would be the same as what was on the ticket.

    This all happened before I took it over from him and I have sent all the template letters on here. The last being that the company needs to take it up with the driver.

    I have just received a letter from them today saying that as the RK admitted to not being there on the day and they have proved he was, this is enough evidence to take him to court and they are confident they will win and they will not be taking part in any further correspondance.

    Now how did I, get it across, is that what the Rk meant was that the car was not there on the day written on the ticket and this differs from the date on the letter they sent.

    Any advice and help will be greatly received

    All the PPC has "proved" is that the car was there that day. They have certainly not proved that the RK was there. How could they - he wasn't.

    All the RK needs to do is to write back, saying something along the lines of:

    "I told you previously that I was not there. If you have issues, you should really take them up with the driver."

    Keep it very simple, they will probably put their foot in it by coming up with some nonsense saying that the Registered Keeper is responsible.

    I would write back as follows:

    I note what you say about not taking part in further correspondence on this matter and propose to hold you to this.

    I further note that you are confident of success in court. I am equally confident that you will note. It therefore appears that there is a de facto dispute between the parties in this matter.
    What this means is that you should hear nothing more on this matter from any one unless and until they commence court proceedings. (This is most unlikely.)

    So, just to be clear in my mind, i dont have to mention when I write back, that what the RK actually meant was that he wasnt there on the date that was printed on the ticket which was different from the date used on the letter.

    Sorry to keep questionning but its a mindfield trying to get your head round this
