    Default Crisis Loan

    Hopefully im posting in the right forum

    My partner recently received a demand for unpaid Crisis Loan from the Dept for Work and Pensions.
    She can find not record of an outstanding amount, remembers the loan but as far as she was aware payments were made through reduction in benefit and paid in full some 7 years ago.
    We sent a letter asking for details and insisting nothing was owed, the reply states the date the loan awarded as 13/01/1999 and an outstanding amount but no payment details.
    This is the only correspondence in 9 years and im inclined to believe there is some mistake on their part but have no way of proving this....
    Is Stature Barred relevent to Crisis Loan???

    The Limitations Act does not apply to benefits, Child Maintenance or HMRC etc, so no Stature Barred is not relevent, but they still have to prove that you owe the debt, what they have sent so far is not enough, send a letter off saying you want a full Breakdownicon of the account, payments made etc

    Cheers for the advise.... i envisaged that SB probaly wouldnt apply but felt it may be the easier way of dealing with the probelm as i dont feel the DWP are going to anything less than very difficult!!!

    rite i am kinda an expert on this side of money as my partner is currently doing battle with them over a specail payment.

    What you need to do is send the office that sent you the letter a letter asking for all details on your claim for the dates of 01/01/1999 to present.

    You will nee to address the letter to the data protection officer for the office.

    They should then pass your letter to manchester who will send you a letter asking for more details dont worry this is normal. just fill out the paperwork, l will help if you want, and send it back.

    They then have 40 days to get back to you.
