Just wanted some advise on a recent online purchase. I purchased 4 pairs of shoes from an online company 2 of each size to ensure correct fit. I paid express delivery for 24 hr receipt and recieved a letter saying one pair was out of stock and would recieve my order complete in 21 days later. It arrived 28 days later, I was however still charged express delivery.
I dully returned the 2 pairs of shoes that did not fit using the royal mail returns label that was sent with the product.
In the literature it does say ''We recommend customers use our courier service as WE can only reclaim £20 form OUR agreement with Royal Mail if goods are lost.
I have since contacted copmpany, they claim never to have recieved returned goods and say its down to me to sort out with Royal Mail, in almost that exact phrase.
I have proof of posting etc.
Question Am I liable for loss of goods that were returned using the companies own returns service? Would it not be down to them to investigate the loss and compensate me for mine?

But you didn't use their courier service, you used RM, according to your post. :-?
Yes, it is your responsability, you're the one who entered into the contract with RM by asking them to deliver the goods back to the company, therefore it is up to you to claim against RM. If you used their standard service though, the maximum compensation you'll be able to claim will be £32 and you will be liable for paying the totality of the money owed to the company.

I realise it sounds bizzare not to have used their courier service, but the goods had to be returned within 10 days and courier could only offer weekday pick up between 09:00 & 18:00 so another day off work?#
I question the ownership of contratc with RM, this was the companies return service, that they had paid for and provided the label return address with business paid postage, surely this was the companies contract with RM to provide a return of goods to them, I had no negotiating powers with RM (as it where), but used the service provided by the mail order company??
No, all they did is give you a label that allowed you to send it back at no cost to yourself. If I sent you a SAE so you could send me whatever, when you use it to send me the whatever, the contract is still between you and the Post Office.
