I sent off for the list of charges and after receiving them sent off the 1st letter, BC sent my own letter back to me stamped as received (weird). I then sent off the second letter which they received on the 9th Feb, since then I've heard nothing no letter confirming acceptance no offer of refund. So do I now just go ahead and file MCOL or give them a couple more days?
PS I have tried calling the CS helpline but with the language barrier they don't seem to grasp what I am asking.
If you have sent your letter demanding chgs back and you have confirmation of safe receipt, it is your timetable and you should file after the 14 days.

You can then take this to your local county court and file it there in person (you know it is in the pipe line then )

I would simply add it on. You've gone through the correct process, sending the requisite letters, giving them time, etc, so they cannot claim otherwise.
I've had two claims against B/Card and both times it went to the court claim stage. And both times they settled a few weeks prior to the court hearing. It's their policy - they won't pay if they can get out of it and will they will test your resolve, for sure. . . but one thing is certain - they will pay up in the end!
Looking at the court fees page it would seem that claims under £1500 would be free, is this correct?
Also I used an online calculator for the 8% interest but the sample file on here said something about claiming interest uptill date of claim filed, so how do you work that out.

On another thread b8byd v Barclaycard they mention "charges + contractual interest + interest applied by BC on the charges + contractual interest on that interest"
Can someone clarify what this is please.
And how to work this all out. Ive used the speadsheat someone kindly posted on here but I must be doing something wrong as it didn't add thing up etc.
From what I've seen on your thread so far, my advice is to stick to claiming the s.69 Statutory interest which Saint gave you the link for above.
If you've read up to post #60 on b8byd's thread, you'll see that claiming CI is far from straightforward and almost guarantees that BC will not make an offer to settle your claim.
Stick to the spready you have, fill it in and include all charges to date. You should end up with one total for your charges and another for the s.69 Int't.

I had letter from BC this morning saying " sorry you had to make a complaint about are service blah blah blah".
I called the number on the letter and spoke a lovely lady, I explained about the charges.
She refunded the FULL charges + 8% total interest, £30.00 short of what I was asking. She even included the 2 that had just been applied to the account. No questions asked.
