now I know that usually these types of threads are about people who buy cars and then are ripped off or in some way out of pocket etc, but this time its the other way around....
To cut a long and annoying story short, I sold a car privately which the buyer later changed his mind and then wanted a refund which I couldn't afford in full at the time...
so I gave him a partial refund and then he got more money when I was payed but I was still short by approx £40....
Up untill this point where I was in a position to give him the rest of the money I still had not received all the documents such as the very important service history back from him and I hadn't made a song and dance about it as I felt that him keeping this would give him some sort of assurance he would get a refund....
Well last night I left him a message which was as follows.....
"i have the money for you here and i will be here tomorrow evening between 7-8.... dont forget the owners wallet with all the docs inside as you forgot to return it with the carim off out now but seeing as it appears you are not at the computer feel free to leave a messege on here to let me know if you will be coming over tomorrow"
to which he replied....
"i'll be there"
and
"All matters resolved"
Well 24 hours passed without a single word from him on my mobile, or online and he turned up at 7pm on the dot which was great.. until I asked him for the wallet with all the documents and he looked at me all confused and said "I dont have it" as if I hadn't said a word about it....
Well I got a bit annoyed that he made no effort to tell me that he didn't have it even though he read and replied to my message so I refused him the approx £40 pending the documents (for want of a better reason, the lack of the service history will seriously reduce the value of my car)....
It was after several moments then he said that he had left it with the car, but I knew he had not as I had checked the car over the same day and the wallet was no where to be seen at all in any part of the car...
So he THEN said that he left it on the seat and it must of been stolen...
Now I know this could not of happened here as there was someone in the house all day, the car isn't easily accessible and had a cover over it (it had no windows at the time but the cover was secure)...
So what I have said is that he failed to return the documents that I gave him prior to him collecting the car and so hasn't returned everything that was included in the sale thus reducing its total value and in with me keeping the £40 the matter is now closed...
Am I in the wrong?
Does he have the right to a full refund even though he didn't return ANY of the documents that I gave him with the car, including the service history?
This has now started to get very stressful for my girlfriend more than me which is why Im turning to you people for help!!
If you have any questions about what Ive said or whats happened then I will answer with haste and detail
