i wrote a letter to say that i have sent of a statutory declareation out of time to the northamton county court and got a reply from sutton council saying that they wouldnt consider any payment arrangement and that i needed to contact the relevent baliff????
I called to ask who the relevent baliff was and they said they would get parking to call back, nothing as yet, i today borrowed the £125.00 they are demanding and sent the cheque next day special delivery can they refuse it.??
I cant afford to pay the £125.00 that alone any fees of a baliff.
Can anyone advise me what to do i am in panic mode now the car is on HP and i cant afford to pay out masses of money, from what i have read i could wake up one morning and have no car on the drive,
You need to post a few more details about where/when you got the pcn, the NtO etc. However, if it has gone as far as the bailiff, the fact that your car is on HP means he is NOT allowed to take it.
right i think i was scared in to paying i will still fight to try and get the "extra back". The ticket was issued in nov 2006... yes 2006. and i applied to the parking adjudicator, the reply of the case never got to me i phoned them to chase, by this time the 28 days had passed, i asked them what to do they said to wait for the atat d, which i did (this only arrived on the 3.01.08, i got it sent back but then got a letter to say the sd had been done out of time so i had to do the sdoot, when i then contacted London bororough of sutton to say can i pay it off over the space of a month,they said that the stooo had not been recieved by them by instruction of court and baliffs were instructed to visit me at home. I have had run in with a baliff before who pushed through the door, it was awful. I juust borrowed the money and sent it.
Thing is i said to the lady you cant send baliff whilst in dispute can you?? ahe said they already had and it would probably trebble the ticket cost and they could remove the car and we would have to pay a holding fee per day also.

Depends on what you mean by "extra". The bailiffs are likely to try and charge much more than they are entitled to. (see other threads for what they are allowed to charge)
It doesn't matter what the bailiff says, they cannot take a car on HP. Remember, DO NOT let them in your house.(Don't open the door and keep windows locked) A bailiff is NOT allowed to push past you at your door. That is not peaceful entry and could even be assault.
As for whether you can get this taken back off the bailiffs by the council, I'm not sure. Someone more expert tham me will hopefully be along to answer that one.
Do you still have the pcn, NtO and Charge Certificate. If so can you post them here after removing personnal data. Some of Suttons PCNs invalid in which case you can claim for restitution against Sutton
