    Default PPI from Next

    I sent Next a template letter from Martins Money requesting they pay back the PPIicon they have been charging me, as I was not aware that I had taken it out; I have been told by one of their employees over the phone that i needed to have unticked a box when applying for a storecard; anyway, they have sent a letter back saying:-

    As the application was requested prior to 2001, they only hold information for 5 year and that my application has been recorded on microfiche. Therefore they do not have the original request and the premiums have been listed on my statements over the past 7 years (i dont have all the statements!!)

    The policy would not have been 'sold' to me but offered, and would have been ticked to opt in.

    With regards to Financial Ombudsmanicon, any policies sold before Jan 05 was not subject to the FSA rules and as such the Ombudsman has no jurisdiction in my case.
    Can anyone advise whether I should carry on with the claim.

    Hello Ann,

    They are trying to stop you before you start and yes they are correct in that the fosicon will not investigate the claim. But you can pursue it via the court

    As regarding your information, write back to them and tell them to revise the DPA section 7 "Right of Access to personal dataicon". They are trying to use the limitations act to restrict your information. Tell them that you want it or you will be reporting the matter to the Information Commissioners Office.

    Section 32 of the Limitations act will blow away, there arguement that it happened before the FSA regulation, They have mis-lead you and you have only realised

    Keep at them

    Hello again

    I responded as advised, they have responded giving me dates PPP commenced and amount paid by me, and that I should have read my statements and should have cancelled at the earliest convenience and are not going to refund any monies.

    What letter should I send next; is there a template and correct proceedure?
