Hi there i hope you guys can help with this. I received a parking ticket from a South Lanarkshire Council warden on 12th July last year, as the ticket displayed on my windscreen was out of time.But the warden had failed to notice the other ticket which had plenty time left on my drivers side window. When i returned to my car later in the day and found the parking ticket i phoned the council parking unit and explained the warden had obviously not saw the valid ticket,so i was told to send the valid ticket in and theyd sort it out. Unfotunately a few days later my father passed away,and as you'd expect all thoughts of the ticket went out my head. The next time i remembered about it was when i received a charge certificate on 10th October explaining the penalty was now ninety pounds. I replied with a letter explaining why i hadnt been in touch and attached the evidence of the valid ticket. I received a letter back on 7th Nov telling me the warden did not see the valid ticket therefore i didnt have it displayed. The letter also explained that they had sent out a notice to owner to me on 30th Aug which gave me right of appeal,but I DID NOT receive this. They also said the penalty had now been passed to debt collection company. I replied again enclosing the valid ticket and asking why i should need to pay for something i was clearly covered for. I received a reply on 26th Nov stating that penalty still had to be paid and had now been passed to the councils sheriff officers. I then received a visit from sheriff officers in late Dec giving me 14 days to pay. I then receive another visit from sheriff officers on 11th January telling me they have now attached my car(which is not on HP) to the debt. I then came home on 25th Jan to find Sheriff officers paperwork through my door(not handed to me?) explaining that they will remove my car on 20th Feb(tomorrow). I have been in contact with citizen advive bureau etc but to no avail. I have also opened a case with council complaints department as i believe they didnt follow proper proceedure as i didnt receive right of appeal. But have been told by parking unit that this wont put sheriff officers on hold. Any ideas what i can do or am i going to have to pay. I know this is all a bit last minute but any help would be appreciated.
