Hi everyone 2 questions i took a loan with Lloyds TSB in 2002 finished in 2007 with PPI i have a feeling i have a case for mis selling as i have been self employed since 1982 and as i have everything with Lloyds they are aware of this.
I do not have my oringinal paper work so do not have the loan account number will this matter when sending off the SAR, also could someone please post the address to send the SAR to.
If you use the Templates for the S.A.R. (Subject access request) and ask for everything they have on you, and provide details of any and all Addresses and Postcodes that you were using at the time, then you should get all the details, Account Codes etc.
See what you get back first, before taking the next step, and don't warn them in the S.A.R. what you intend. Gather all the evidence first.
Loan PPI and Self-Employment is a bit of a grey area at the moment, we all know most PPI is useless, but some, like my MBNA Loan PPI and American Express Loan PPI do use weasel words like "also available to the Self-Employed" and do ramble on about limited Unemployment Cover being available.
Some don't cover Self-Employment at all, so you could be in a better position if the PPI terms and conditions (which you should get from the S.A.R.) specifically require you to be Employed and make no mention of being Self-Employed at all.
In that case, you could well be half-way to victory already!
I intend to fight the MBNA despite the fact they have some "Self-Employed" wording in the PPI, as the PPI is actually no real use in practice. Claiming against it when Self-Employed looks pretty certain to fail with the exception of very limited circumstances they could easily contest in any event.
I would also advise that you insist they keep it in writing, don't let them use the Telephone, as you may find it works against you and never for you. Once it is in writing, you have an Audit of what was said and when.
Good luck, the key is to get the S.A.R. away first, and then plan what to do next before you do it.
