Hey Bernie, Longball here, I too was given a pcn for being in an unclear bus lane. The Islington Council did not list the charge or reduced charge, and they have a pictured my car at 18:30:38 & 18:30:40, but the PCN lists it to have occured at 14:30. I know there is a way around this, but how should it
be worded? Can I just get away on the ground the price is no there or should I add something regarding the wrong times listed?? Look forward to your answer. Thanks again. Longball

Anyway, in your shoes I would write to the LA as informal reps and tell them that there are material and substantial discrepancies in PCN because the pictures show the car at 18:30:38 & 18:30:40, but the contravention states that the time of occurrence was 14:30. These material and substantial discrepancies mean that the LA cannot rely on the accuracy of their equipment to determine that a contravention occurred at all or at what time and that the PCN is therefore unenforcable.
I have no idea what the postion would be in if it is was a 24/7 bus lane.
Are you sure that the 14:30 is not the time of issue of the PCN the following day?

It might be a good idea to post a copy of the PCN here with the reg and PCN obscured so that it can be examined. It would clear up this question and there may be other faults with the PCN that make it invalid.

How can you pay a penalty charge if no charge is detailed? I would use those grounds, adding the time issue as backup for "material and substantial discrepancies". Basically, they haven't got it together, but those words are so much better.

Thank you all for your help, I too thought they had really dropped the ball on this one, hopefully to my benefit. I have gone with "the penalty exceeds the relevant amount. The relevant amount is zero as the pcn is non compliant by not stating the amount due or the amount of the reduced charge." I heisted this one I think Bernie giving this advice to another on this site. By the way, thank you Bernie. Anyway I have tried to attach the PCN so you can have a look, but this site asks for the URL. I have scanned the pcn to my pc but do not know how to attach it from there sorry for my ignorance but thems the breaks I guess. I have double checked the time on date of contravention and it is not correct and no amount reduced or otherwise has been listed. Thanks again...Longball
