    Default "parking in a restricted street"

    Hi,

    I received a pcnicon today in a street off Oxford Road in Manchester.

    The road which I was parked on had single yellow lines with signs on it, but I didn't park in the road on the yellow line; I parked in an apparent bay (a cobbled area, about 15 x 4 metres - not what I'd call pavement - at the side of the road). It's a place where there are always cars parked. I even had to wait for a car to leave so I could get a space. There were 4 other cars parked in this area.

    When I got back to my car, most of the cars had gone, but the one remaining car didn't have a ticket on it, which really p*ssed me off.

    I was always under the impression that you could park off the road, as long as it's not on the pavement, which this wasn't. I've checked the highway code, and it states that you can't park on the verge or pavement by a single yellow line either, and I'm pretty sure what I was parked on couldn't be described as either of these.

    On these circumstances, do you think I've got any valid grounds for appeal?


    In terms of potential problems with the PCN, the signatureicon is over the parking attendant number, obscuring at least the third digit.

    There is also a line, which reads:

    From/To: 15:39/15.44 hrs At: hrs

    As you can see the "at....hrs" bit hasn't been filled in.

    Are either of these - admittedly pedantic - points grounds for appeal?

    If there is a yellow line in the street in force you cannot park anywhere on the same side as the line from the centre of the carriageway to the private property boundary. Since its a single line I assume the bay if for use outside of the restricted times.

    I guess so, yes (so any time between 18.30 and 8.00).

    Any idea where it says about the yellow line rules? I couldn't find anything along those lines in the highway code.

    From the Highway code...

    Waiting restrictions indicated by yellow lines apply to the carriageway, pavement and verge. You may stop to load or unload (unless there are also loading restrictions as described below) or while passengers board or alight. Double yellow lines mean no waiting at any time, unless there are signs that specifically indicate seasonal restrictions.

    Its written in simplified form but basically it means the same as I stated anywhere that is not private property on the same side of the road as the line.

    That's the same bit that I read then.

    I'm assuming you don't think that claiming that it wasn't "carriageway, pavement or verge" will do me any good then?

    No, the Highway code is a motorists 'guide' to the law the legislation is more detailed. You would have a hard time because if its not verge it would be highway therefore restricted.
