    Default HFC (complicated)

    Last year i made a complaint to fosicon about the mis selling of PPIicon by Beneficial Finance. When it finally got sorted out i recieved just over £500 back but now i hear that they have been fined for mis selling i think this is wrong.
    I originally took the loan out in 2003 for £7,683.00 and it was a whopping 31% apr.
    The PPI which i was told i had to take was £1,231.42 and also with 31% apr which i wasn't told about came to £3,435.60!!! This was never made clear to me when i took out the money and had it had been i would never have taken it.

    When the case was looked at by the FOS (which was before their mis-seling findings of HFC) They ruled that i could only recieve back what i had paid towarsds the PPI (i had to take the loan over longer period of time as i was making reduced payments) which came to around £500.

    As i knew no better i took this and recieved a letter from HFC telling my cover had now been cancelled with effect from October 2006 (when i originally complained)
    Know where in any paperwork i have recieved from the FOS does it mention i was mis sold the PPI only that i have recieved back what i have paid.

    As i have already recieved this back does this prevent me from making another compliant to HFC to get the whole amount taken off the loan (£3435.60) + interesticon - 500 i have already receieved back? If so would it be a straight forward letter to HFC or as it was taken out in 2003 is there another way i have to do it?

    Hello willsicon,

    When the ppi was cancelled, what happened to the remaining ppi and interest that you had not paid/ Did they rebate it into the loan balance and reduce the amount owing Maybe sent another SARicon to see what they did. Or maybe write to them and ask for a breakdown of the loan before and after the cancellation of the ppi

    You may find that the fos may not investigate your complaint, but maybe give them a ring for advise. Worth a phone callicon.

    If they will not re-investigate your complaint then your other option is court.

    Hfc will argue that the complaint was resolved in 2006

    I have just rang them to get a balance of the loan and it seems thay have only refunded the £500 which were the premiums i had paid up until october 2006. I don't understand that if i cancelled the PPIicon why is it still on the loan surely the whole amount of £3,435.60 shouild have come off??? Sueley if it is canceled it should not still be on the loan? i am very very confused and unsure what to do next..
    My original complaint was that it was mis sold do i just hit them with a letter now saying that unless this is sorted asap i will take action by way of the courts as they have already been fined for mis selling?

    Having spoke to them again they are now saying that i have to paid the first 3 years of the loan but have knocked off the last 2 years because that is when i complained. How can i now go back to getting the first 3 years refunded to my account which is what i originally wanted?
