    Default Car insurance claim woe

    My son renewed his car insuranceicon as usual - he received a letter and renewed over the telephone. He was recently involved in a car accident which was not his fault. Someone pulled out of a side road without looking and hit the side of his car.

    He completed a claim form but has been told that the insurance company won't pay out as he picked up some penalty points which they were not aware of. My son is adamant that he told the insurance company during the renewal process.

    Is there anything that can be done? The renewal process was all done over the telephone - there was no form to complete. You'd think the insurance company would ask as a matter of routine whether your circumstances have changed.

    Does this mean that my son was driving whilst technically not being insured?

    Hi Framus,

    under ABI (association of British insurer) guidelines, Insurers are advised to record 'proposal' calls, this is the telephone callicon in which the proposal is made to offer insurance- ask the insurer to check these.

    Also, your son's SOI (Statement of Insurance) should show these conviction(s)- ultimagtely, if he hasnt checked this, it is his fault, the SOI is the contract between the policyholder and the insurance company.

    The insurer is likely to issue a final response, to say that they will or wont deal with his accidental damage claim- if they dont, it is likely that they will void the policy.

    He hasnt been driving without insurance, as the insurer would have to pay for any third party damage, as they will be registered as insuring that vehicle.

    He needs to ask the insurer what they are doing- it may just be that they have referred the claim to work out any additional premium that would be charged on the policy had they been aware of the conviction.

    Also, what conviction is it?
